Pool Pros of West Tennessee, Contractor Terms of Service, effective October 22, 2026
These terms apply when a pool company, contractor or other business ("you") joins Pool Pros of West Tennessee ("we," "us") to receive homeowner requests. We charge a fee only when a job we matched to you is confirmed, as described in section 4. By saving a payment card or clicking to accept, you agree to these terms.
1. What we are
We are a directory and matching service. We list companies and send you requests from homeowners who ask to be matched. We do not perform pool work, we are not your agent or employee, and we are not a party to any agreement between you and a homeowner.
2. What you get
A company profile in our directory, placement on the relevant builders and services pages, and homeowner requests ("leads") sent to you by email, text or another agreed method. Listing and receiving leads cost nothing. We do not guarantee any number of requests, any level of ranking or any resulting sales.
3. Eligibility and your information
You confirm that you are authorized to represent your business, that you hold every license, registration and insurance that applies to the work you offer in Tennessee and any other state where you work, and that the information you give us (name, contact details, services, service area, license numbers) is accurate. Tell us promptly if it changes. We may remove or suspend a listing that is inaccurate or out of date.
4. Fees and billing
- Performance fee: We charge a fee only on a job that we matched to you and that is confirmed under section 5. There is no setup fee, subscription or charge per lead.
- Rates: New pool construction, remodeling and replastering, equipment replacement, hot tubs and spas, and outdoor living: 10% of the completed job price. Recurring maintenance service: a flat $200, charged once per new customer after the first month of service is confirmed.
- Card on file: You provide a payment card through Stripe. By doing so, you authorize us and Stripe to charge that card for fees owed under these terms. We never see or store your full card number.
- When we charge: After a job is confirmed, we send you a notice with the amount. We charge the card 7 days after that notice unless you dispute it under section 5.
- Taxes: You are responsible for any taxes that apply to your purchase, other than taxes on our income.
- Failed payments: If a charge fails, we may retry it, pause lead delivery or remove your listing until the fee is paid, and you remain responsible for the fee.
5. Job confirmation, disputes and refunds
A job is confirmed when the homeowner confirms to us (by reply, form, call or other method we offer) that they hired you for work we matched, or when you confirm it to us. We may contact the homeowner to check, and you agree to tell us promptly when you win or complete a matched job and the price. You must not avoid a fee by steering a matched homeowner around us, splitting a job, or delaying or misreporting the price. If we find an unreported job, we may charge the fee and suspend your listing.
If you believe a fee is wrong (for example the homeowner did not hire you, the lead was a duplicate or the contact details were invalid), tell us in writing within 10 days of our notice. We will review it in good faith and credit or adjust the fee where the facts support it. Fees are otherwise non-refundable, except where the law requires. We decide disputed confirmations after reviewing what both sides provide.
6. Homeowner requests (leads)
- We send homeowner details only where the homeowner agreed to share them.
- You must use the information only to respond to that request, and may not sell it, share it with others or add the person to marketing lists without their separate consent.
- You must contact homeowners promptly, follow the law on calls, texts and email, and honor requests to stop contact.
- We do not guarantee the accuracy, quality or intent of any request.
- If you give homeowners an estimated time to be reached, you agree to meet it. We may also follow up with homeowners by text or email to ask whether they were contacted and whether they hired you, and you agree that we may use their answers to confirm jobs and fees.
7. Your conduct
You agree to deal honestly with homeowners, to price and perform work as you described it, and not to post false, misleading or infringing material. You will not misuse the site or our tools, or interfere with other companies' listings.
8. Ratings, rankings and content
Ratings and review counts on our site come from public Google listings and may change or be incomplete. Where we show companies as top reviewed or featured, we say how we choose them. A paid plan does not change the ratings we show. You give us permission to display your name, logo, photos, service descriptions and contact details on the site and in our marketing. You confirm you have the rights to anything you give us.
9. Ending the relationship
You can end your participation at any time by emailing us; fees owed on confirmed jobs, and on jobs matched to you before you leave, remain payable. We may suspend or end your listing at any time if you break these terms, if complaints suggest a risk to homeowners, or if we end the service.
10. No warranty
The service is provided "as is." We do not promise that it will be uninterrupted, error free or produce any particular result.
11. Limit of liability
To the extent the law allows, we are not liable for lost profits, lost business or indirect or consequential damages, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim.
12. Indemnity
You agree to protect us from claims, losses and costs that arise from your work for homeowners, your breach of these terms or your violation of the law.
13. Privacy
Our Privacy Policy explains how we handle information, including homeowner details we share with you and your business information.
14. Changes
We may update these terms. If a change is material, we will tell you before it applies to new matched jobs; jobs already matched keep the rates in effect when they were matched. We may assign these terms, and our rights and obligations under them, to a successor or affiliated entity (for example a company formed to operate Pool Pros of West Tennessee) without your consent, and we will notify you if we do. You may not assign these terms without our written consent.
15. Governing law and disputes
These terms are governed by Tennessee law.
